KFC Original Holiday Traditions Contest Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN.
KFC Original Holiday Traditions Contest (“Contest”) starts on November 24, 2008 at 8:00 a.m. Eastern Time (“ET”) and ends on December 11, 2008 at 10:00 a.m. ET (“Contest Period”).
ELIGIBILITY: Contest is open to legal residents of the fifty (50) United States and the District of Columbia, who are of the legal age of majority in their state of residence (and at least 18 years of age) and who have internet access during the Contest Period. Employees of KFC Corporation (“Sponsor”), KFC National Council and Advertising Cooperative, Inc. (“NCAC”), Weber Shandwick, and their respective parents, subsidiaries, affiliates, franchisees, members, licensees and promotion and advertising agencies, and members of their immediate family (spouse, mother, father, sister, brother, ward, daughter or son and their respective spouses, regardless of where they reside) and persons living in the same household of such employees, whether or not related, are not eligible to enter or win. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws.
HOW TO ENTER: KFC wants you to submit a photo or video of your Original Holiday Traditions (collectively, with video or photo submission form, the “Entry”)! During the Contest Period, visit www.KFC.com and complete the video and/or photo submission form. To submit a video of your Original Holiday Traditions, upload your video to www.YouTube.com and add it to the KFC Original Holiday Traditions group. If you do not have a YouTube account, you will have to create one in order to upload a video. To create a YouTube account, go to www.YouTube.com and follow the instructions to create an account. You must agree to the YouTube Terms of Use, located at http://www.YouTube.com/t/terms, and the YouTube Privacy Policy, located at http://www.youtube.com/t/privacy to create a YouTube account. Creating a YouTube account is free. Each entrant must be the rightful owner of the email address registered with the YouTube account used to log-in and upload the video submission. Video submissions should not exceed two (2) minutes in length, and must comply with all YouTube size and format requirements. Approved videos will be posted to a KFC YouTube group. Or, to submit a photo of your Original Holiday Traditions, please email your photo as an attachment and up to a 100-word description (maximum 500 characters) of your family’s holiday tradition to: KFC.PublicRelations@kfc.com, along with your full name, email address, complete address, date of birth and phone number (area code included). Photos must be submitted in .JPG format and must be no larger than 2 MB in size. Selected photos will be posted to a KFC Flickr group. Description of your family’s tradition must be no more than 100-words (maximum 500 characters), and sent within the body of your email, not as an attachment. Both video and photo submissions must have been captured within the past two (2) years. All Entries must be received by 10:00 a.m. ET on December 11, 2008 to be considered. Entries generated by script, macro or other automated means or by any other means which subvert the entry process are void. Limit one (1) Entry per person, per email address and per household. All Entries become the sole property of the NCAC and will not be returned.
REQUIREMENTS OF ENTRIES: Entry may not contain, as determined by the Sponsor, in its sole discretion, any content that:
- is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
- promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
- is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;
- defames, misrepresents or contains disparaging remarks about other people or companies;
- contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
- contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in Web sites, television, movies or other media), without permission;
- contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
- contains look-alikes of celebrities or other public or private figures, living or dead;
- communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
- violates any law.
Entry must be entrant’s own original work, be owned by entrant, may not have been previously published, may not have won previous awards, must be in keeping with the Sponsor’s image and not be offensive or inappropriate, as determined by the Sponsor in its sole discretion, nor can it defame or invade the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. By submitting an Entry, entrant represents and warrants that he/she has the right and permission to use the images, videos and other materials appearing in the Entry and to grant Sponsor, NCAC and its designees the rights granted by entrant, and the names and likenesses of any persons appearing in the Entry, including the permission of the parents or legal guardians of any persons appearing in the Entry who are considered minors in their applicable state(s) of residence. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render Entry null and void. By submitting an Entry, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the Entry consent to the submission and use of the Entry in the Contest and to its use as otherwise set forth herein. Entries must be original and unaltered images or videos of entrant’s Original Holiday Traditions. Sponsor reserves the right to disqualify any Entry it deems, in its sole discretion, to not be in keeping with Sponsor’s image, to be inappropriate or offensive or that is otherwise not in compliance with these Official Rules.
By submitting an Entry, entrant hereby grants permission for the Entry to be posted on the KFC YouTube or other Sponsor Web sites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry. Entrants agree that they will not use the Entry for any other purpose, including, without limitation, posting the Entry to any online social networks, without the express consent of Sponsor in each instance.
ANTICIPATED NUMBER OF CONTESTANTS: Sponsor cannot accurately predict the number of contestants who will participate in the Contest.
JUDGING:
Semi-Finalist Determination: All eligible Entries received by Sponsor will be judged by a panel of qualified judges on the following criteria: Originality and Creativity (75%), and Appropriateness to KFC Image (25%). The twelve (12) Entries that receive the highest scores, as determined by Sponsor in its sole discretion, will be declared potential “Semi-Finalists.” In the event of a tie, an additional “tie-breaking” judge will determine the Semi-Finalist(s) based on the criteria listed herein. Sponsor reserves the right to choose fewer than twelve (12) Semi-Finalists if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries.
Grand Prize Winner Determination: Semi-Finalist Entries will be posted on www.KFC.com from 8:01 a.m. ET on December 15, 2008 through 9:01 p.m. ET on December 19, 2008 (the “Online Voting Period”). A visitor to the site meeting the eligibility requirements for voting as set forth at www.KFC.com will have the opportunity, during the Online Voting Period, to vote for the Semi-Finalist Entry he/she thinks is the best based on Originality and Creativity. Each voter must follow instructions on www.KFC.com to submit his/her vote. Limit one (1) vote per person and per email address for the entire Online Voting Period. Subsequent votes by a single person or email address will be void. Votes generated by script, macro or other automated means or by any other means intended to impact the integrity of or subvert the voting process, as determined by Sponsor, in its sole discretion, will be void. Semi-Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, as determined by Sponsor in its sole discretion, including, without limitation, by offering prizes or other inducements to members of the public. The Semi-Finalist Entry that receives the most votes, as determined by Sponsor in its sole discretion, will be declared the Grand Prize Winner, subject to verification of eligibility and compliance with these Official Rules. In the event of a tie, tied Entries will be re-judged by a “tie-breaking” judge on the basis of Originality and Creativity (100%) to determine the potential Grand Prize Winner.
Judges’ decisions are final and binding on all matters relating to this Contest. The potential Grand Prize winner and potential Semi-Finalist winners will be notified by telephone, mail and/or email, and each will be required to complete an Affidavit of Eligibility and a Liability and Publicity Release (unless prohibited by law), which must be returned within fourteen (14) days of date of prize notification. Return of a prize or prize notification as undeliverable, failure to sign and return requested documentation within fourteen (14) days of the date of issuance, noncompliance with these Official Rules, or the inability to contact a potential Semi Finalist winner or the potential Grand Prize winner within a reasonable time period may result in disqualification and, at Sponsor’s sole discretion, the prize may be awarded to a runner-up.
PRIZES: Grand Prize (1): KFC® gift checks with a total value of $1,900, which may be used toward the purchase of KFC products at participating KFC restaurants in the United States, and $1,000 to help carry-on his/her Original Holiday Traditions, awarded in the form of a check. Approximate Retail Value (“ARV”) of Grand Prize: $2,900.
Semi-Finalist Prizes (11): KFC® gift checks with a total value of $155, which may be used toward the purchase of KFC products at participating KFC restaurants in the United States. ARV of each Semi-Finalist Prize: $155.
KFC® gift checks are subject to terms and conditions specified by NCAC. All prize details are at the sole discretion of Sponsor. All prizes are awarded “as is” with no warranty or guarantee, either express or implied. No substitution, transfer, or cash equivalent of a prize is permitted, except by Sponsor, which reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Any and all federal, state and local taxes on prizes, and any other costs, fees, and expenses associated with prize acceptance and use not explicitly stated herein as being awarded, are the sole responsibility of the Grand Prize winner and Semi-Finalist winners. Total ARV of all prizes: $4,605.
GENERAL: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge, indemnify and hold harmless Sponsor, NCAC, Weber Shandwick, and their respective parents, affiliates, subsidiaries, franchisees, members, licensees and advertising and promotion agencies, and each of their respective officers, directors, shareholders, employees, agents and representatives (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property damages, arising in whole or in part, directly or indirectly, from entrant’s participation in the Contest or the acceptance, possession, use or misuse of a prize, including, without limitation, any liability, losses or damages arising from entrant’s violation of the privacy or publicity rights of any other person or entity; and (c) to the use of his/her name, voice, performance, Entry (and all rights embodied therein), including without limitation photograph/video, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor, NCAC and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.
By submitting an Entry, each entrant grants the Sponsor, NCAC and its designees an exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable, transferable right to exploit the copyright and publicity rights in the Entry, and any ancillary and subsidiary rights therein in any media now or hereafter known, with respect to the Entry, including without limitation the right to edit, publish, use, adapt, exploit, modify, copy, disseminate or dispose of any Entry, the concepts embodied therein or any elements thereof, proper names, likenesses, addresses and locations, online, in print, film, television, or in any other media for programming, advertising, publicity and promotional purposes without compensation or notification to the entrant of any kind, except as prohibited by law.
Released Parties are not responsible for late, lost, damaged, misdirected, incomplete, illegible, garbled, delayed, undeliverable, destroyed or stolen Entries, videos or images or any combination thereof; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), Web site, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether technical, computer, network, printing, typographical, human or other errors relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the process or judging of Entries, the tabulating of votes, the announcement of the prizes or in any Contest-related materials. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the Web site. Sponsor may disqualify anyone from participating in the Contest or winning a prize if, in its sole discretion, it determines that such person is attempting to undermine the legitimate operation of the Contest by cheating, deception or other unfair playing practices, or intending to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives and all associated Entries and/or votes will be void. ANY ATTEMPT TO DAMAGE ANY WEB SITE OR DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND NCAC RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Sponsor reserves the right in its sole discretion to cancel, modify or suspend the Contest or any portion of the Contest, including these Official Rules, should virus, bugs, unauthorized human intervention, human error, events beyond Sponsor’s control, or any other cause corrupt the administration, security or proper play of the Contest. In such event, Sponsor may, but is not obligated to, determine the winners from among all non-suspect, eligible entries received up to time of such impairment using the judging procedure outlined above.
